So I Got a DUI — Now What?

Being arrested for driving under the influence (DUI) in Alabama can be one of the most stressful and confusing experiences a person faces. What you do—or don’t do—in the moments following a traffic stop can have a serious impact on your case and your future.

The most important thing you can do right away is invoke your Fifth Amendment right to remain silent. Anything you say to law enforcement—no matter how harmless it sounds—can be used against you later in court. You are legally required to identify yourself and provide your license, registration, and insurance, but you do not have to answer questions about where you’ve been, what you drank, or how much. Politely tell the officer that you wish to remain silent and would like to speak with an attorney.

When it comes to breathalyzer testing, there’s no universal right or wrong answer. Refusing the test can have immediate consequences—the state may suspend your driver’s license and could require you to install an ignition interlock device if you later seek reinstatement. On the other hand, submitting to the test could provide the prosecution with key evidence against you. An experienced attorney can review the facts, evaluate procedural issues, and help protect your license and your rights.

After your arrest, you’ll receive a court date for “plea day” and, if necessary, a later trial date. Plea day is when most cases are resolved—either by plea agreement or by scheduling the matter for trial. Even if your case doesn’t go your way in municipal or district court, remember that isn’t the end of the road. Under Alabama law, you have the right to appeal and receive a completely new trial in circuit court.
